Piard and the type of the case was assault which is under section 264.1 (a) of the criminal code. The players in this case were Judge Pilon, Duty council Judy Guidulin, the crown who was Anne Fitz Patrick, the accused Scott Piard, and the accused 's mother who was Marie Claude Delva who was giving a testimony. Anne Fitz Patrick stated that Scott Piard seeks detention on the 5 counts of assault, threats, 3 counts of causing disturbance of screaming, molesting, and being drunk. Judy Guidulin then stated the facts that the accused, Scott Piard had asked the victim, Mr. Trail, for a cigarette and Mr.Trail said no, so Scott pushed him and kept asking for a cigarette when Mr.Trial kept saying no to him and wanted to go home. Scott then pushed him yelling, “give me a cig i know you have one” then kicked and pushed him and started screaming, disturbing traffic in the area, and molesting people, the reason for this being is because he was intoxicated. Another witness whose name was Cunnignham took a picture of the accused, and also threatened to kill him and Mr. Mueller. Police then attended the scene and Scott was then arrested. Mr. Trail suffered minor injuries. There was then a testimony where Marie Claude Delva who is Scott 's mother had testified to bail him out. The reason why I think that the bail was abandoned was because Marie wasn 't giving a straight yes or no answer to the question, “do you want to bail Scott out?”, so Judy thought that it was a good idea to not make a decision and to just abandon it since Marie was unsure that Scott may not respect the condition. This shows that equity and the rights of the accused are being compromised because although the accused, Scott, was not bailed out, there was a condition that was offered to bail him out from the court if he had respected it. They even allowed his mother Marie to testify just so she can bail him out, but since she was unsure of his actions to respect the condition, Judy had decided to abandon the bail for his mother to think about her decision and to make the right one.
