The Bureau of Exceptional Education and Student Services (bureau) received a state complaint from Megan Collins, Esquire, on August 26, 2016, alleging that the Leon County School District violated federal and state laws relating to the education of students with disabilities. The complaint did not contain all of the required components.
During a telephone conversation on September 19, 2016, the complainant provided the facts that supported an IDEA violation. Specifically, the issues are:

IEPs were submitted for the student for the following dates: May 19, 2015, August 20, 2015, September 28, 2015, December 4, 2015, December 16, 2015, February 10, 2016, February 23, 2016, April 6, 2016, August 11, 2016, and August 26, 2016. The student’s annual goals for all IEPs were in the curriculum and learning, social and emotional behavior, independent functioning and communication, and required activities such as identifying and categorizing words or objects, counting objects, writing and typing, demonstrating nonaggressive behavior, transitioning from task to task, performing tasks independently and making choices. 2. Copies of IEP progress reports were provided by the district for reporting periods during the 2015-16 and 2016-17 school years. The student’s IEPs stated that “parents will be provided periodic reports of their child’s progress toward IEP goals.” By the end of the 2015-16 school year, the student was listed as having made progress on the majority of annual goals and the student was described as “likely to achieve” all annual goals included in IEPs during the 2015-16 school year.
3. The student’s academic history report indicated that the student received “straight As” during the 2015-16 school year. The student’s schedule indicated that the student was enrolled in Access courses during the 2015-16 school year.
4. According to the student’s attendance record provided by the district, during the 2015-16 school year, the student was absent for a total of 10 days. A letter dated September 1, 2015, from a physician, requested that “until proper support is in place,” the student “be placed on a shortened school day of 9:30 am until 12:00 pm, Monday through
