Since society is not preparing to avenge the crime, there would be nothing egregiously unfair about going straight to trial. In reality, Tortorici’s trial was a moral one. Although the prosecution acknowledged Tortorici’s overt mental illness, they emphasized that the jurors must consider whether he was legally insane, arguing that: “The issue is not whether Ralph Tortorici is crazy, insane ……

This was the first case I have ever studied and actually took an in-sight look on, and let me tell you, I was very unsatisfied, sick to my stomach and angry, to say the least. I am upset that it took twenty-three girls to be raped and even three murdered in order to finally see justice served, that in my opinion wasn’t even served. First off, just because the Scarborough rapes had stopped, they felt that there was no need to put Paul Bernardo’s DNA samples as high priority, and as a result pushed them to the back of the line and had to wait three years to hear an answer that many detectives had thought they knew anyways. What also upset me is that Paul Bernardo had the audacity to ask if he was able to have day parole. To even think that he feels he has a right to be in society is sickening, and the fact that he has shown no remorse for everything he has done proves that he is a psychopath.…

A 7-2 majority ruled on the case of Dred Scott v. Sanford, citing a wide variety of constitutional grounds for support. One of the weakest arguments of this case was the argument for Dred Scott not being able to be classified as a citizen. As a result, he was not subject to the full right of freedoms and due process of law. Taney wrote that slaves lacked sovereignty and that they were not intended to be included by the framers of the Constitution (5). He writes that slaves were actually, “intended to be excluded from it.”…

On the contrary, Jerry’s argument stating that original thinking is attainable may never be confirmed, but there will always remain a possibility that possessing an original thought is a reality. If there is a way to focus an Individual’s train of thought so that there is nothing pressuring their decisions, Twain argues that you need a setting like a, “jury-room closed against outside influence” (Twain 251). With the ability to tune out all aspects of life and only listening to the facts with no sway from past social interactions an original thought can be made. Original thinking is something that can be occur only if an Individual is able to have an opinion based on strictly facts.…
