“The Age Discrimination in Employment Act (ADEA) prohibits the refusal or failure to hire, the discharge, or any discrimination in compensation, terms, conditions, or privileges of employment because of an individual’s age (forty and older)” (Cihon, 2014). The main effect is to prohibit mandatory retirement ADEA recognizes that age may be a bona fide occupational qualification (BFOQ). There are some limited exceptions to ADEA.
For example, Sarah is an employee of ABC Company. She is 45 years old and perform her job at a level that met her employer’s legitimate expectation.
