Teenagers Nudes And The Law Analysis

Decent Essays
In “Teens, Nude Photos and the Law”, published February 2009, Dahlia Lithwick, a law graduate from Stanford University addresses law enforcers, members of the justice system and parents on the court cases about teenagers prosecuted for sending and receiving nudes. Because of the new trend of “sexting”, teenagers send each other nudes. Since the teens in the nudes are underage, the nudes categorize as child pornography. Therefore, teens caught sending and in possession of nudes are punished for the distribution and possession of child pornography and labeled as sex offenders. Lithwick disagrees with the verdicts and argues that child pornography laws should not be used against the people they were made to protect. Lithwick uses an informative

The following article On Punishment and Teen Killers, by Jennifer Jenkins, who is a high school teacher, believes teens who commit crimes should go through the same consequences as anyone else. Jenkins has the lowest ethos because she uses more emotion rather than logical statistics to defend her argument. Jenkins provides an example of a teen crime, and how it occurred in her family. Her youngest sister was carrying an unborn child and was shot by a teenager, and his reasoning behind the action was, “see what it would feel like to shoot someone (2).” Jenkins creates agony between her and the reader about this gruesome situation.…

    Pros And Cons Of Sexting

According to the Merriam-Webster dictionary, sexting is defined as “the sending of sexually explicit messages or images by cell phone.” After reading about sexting and several cases in our textbook, in my opinion I think there are some flaws to this law. Although it is obvious that sexting can lead to consequence to those who become victims it seems like it should only be applied to certain things and not everything. For example, the female juveniles who took nude photos of themselves, and sent them to three boys should not face felony criminal charges. Based on the minimal facts given in the textbook, it does not make sense to charge someone who took nude photographs of themselves with child pornography because they are under 18 and in addition…

Most people would agree that murder is wrong. Most people would also agree that pedophilia is wrong. When it comes to the case of virtual murder and virtual pedophilia, people’s opinions tend to change. The general consensus is that virtual murder is morally permissible, as no one is actually harmed. However, even though no children are actually harmed, people view virtual pedophilia as morally impermissible.…

Children committing heinous crimes are not a rare occurrence anymore; the upsetting reality requires new tactics for dealing with young juveniles. Some Americans believe children should be tried as adults, yet others feel that they are too young to understand their wrong doings. In most conditions minors are quickly told they are too young or too old for something, however before being sent to an adult facility we need to contemplate all aspects of the case in order to decided whether or not being tried as an adult is necessary. Regardless of the crime, some people feel that an adult facility is not a suitable environment for children to serve their sentences.…

    Convicted At 14 Summary

As stated previously, maturity is not in what is being said but in what is being shown. The text “Convicted at 14”, manifestly exhibits is that children are not mature. The author starts off his article by means of presenting the fact that not only adults are capable of defying the law, but even young adolescents are able of this. An example of this is that Lionel Tate, a twelve year old and Nathaniel Brazill, a fourteen year old were competent to even think about murder, let alone execute a crime this violent, whether it was done deliberately or unintentionally. In addition, the author expresses how children are immature and the boundaries established for adolescents.…

Should teens be convicted like adults? Juveniles should be convicted as adults for violent crimes because they made an adult decision to kill someone. Some teens plan to murder someone for a very long time they watch TV and want to do the same thing to someone. Many people think that kids shouldn't be convicted as adults for committing a crime, but some people say that they should be because they decided to make an adult decision and kill someone. “On March 9, Lionel Tate who was twelve when he savagely beat to death a six year old girl”.…

The article came from an online source which I was exposed to a year ago. The online source was from the “Journal of Criminal Justice and Popular Culture, 14,(1), 2007” which it is from the School of Criminal Justice, University at Albany in 2007. The title of the scholarly article is “Juvenile “Super-Predators” in the News: A Comparison of Adults and Juvenile Homicides” by Pizarro, Chermak, and Gruenewald from Michigan State University. This article is highly interesting because I am pursuing a career working with Juveniles as a Probation Corrections Officer in the County of San Bernardino. Therefore, be aware of these history facts puts me in a stand of what type of people I will be working with.…

The piece titled Becoming “Real Men”: Adolescent Masculinity Challenges and Sexual Violence by James W. Messerschmidt is a work published by Westview Press in 2000 and part of a book titled Men and Masculinities. This excerpt is meant to raise awareness on the lack of studies done on gendered adolescent male sex offenders. To do this and to clarify research issues Messerschmidt interviewed two white males, Sam and John, both from working class families in the year of 1997. Sam grew up in a loving family while John grew up in a very hostile and sexual violent family. Messerschmidt wished to compare and contrast the lives of these two teenage sex offenders by analyzing the different ways their masculinity was in peril and understand the offender's…

No, because, Images of a child (pictures, videos, etc., created only to arouse people sexually) are not protected under First Amendment rights, and are illegal things that someone has under federal law. I will be addressing how the youth curfew law infringes the rights and freedoms of the youth that are protected by the Charter. The municipal by-law discriminates against the child-age, imposing limitation on the child’s freedom, and infringes the parents right to raise a child without any state interference. The constitutionality of the curfew law will be explored with the reference of American case law. To keep in mind, that such a legislation should not interfere with or outweigh an individual’s rights and freedom. In the United States, two Federal courts have decided that, “non-emergency youth curfew ordinance do infringe upon constitutionally guarantee rights of youths”…

Rhetorical Analysis I will be analyzing, "The Supreme Court Says Again: Juveniles Are Different”, a 7 paragraph article written by the Editorial Board and published to the New York Times on January 25, 2016. In discussions of The Supreme Court’s repeated ruling over the last decade, it has become a controversial issue that it is morally and constitutionally wrong to equate offenses committed by emotionally undeveloped adolescents with crimes carried out by adults. While some argue that no matter what age, if a person where to do something so cruel, for example, kill someone, they should be entitled to life in prison.…

Susan Minot’s story titled Lust is written in first-person perspective and it revolves around the adolescent life of a 15-year-old girl as she lives in boarding school. The narrator is the girl herself, unnamed and anonymous in terms of characterization; very accurately depicting someone with low self-esteem. The story opens right away with the character introducing the boys she’s met during her time at boarding school but goes no more into depth about them than mentioning the sexual experiences they have had, such as seeing one naked for the first time or French kissing another. The readers get little, if any, description of the male characters beyond their names.…

    Essay On Paedophile

    • 3621 Words

This essay will posit that in contemporary Western societies a cultural contradiction is apparent. On the one hand there is anxiety surrounding child sexual abuse (CSA) particularly around the concept of ‘the paedophile’. Yet, this concern is situated within a socio-economic and cultural context that simultaneously constructs children as sexually desirable. This essay will argue that these should not be seen as separate issues but rather as interconnected. That is, it is only through seeing these two issues in conjunction with one another that any resolutions will be able to be reached.…

The decision of juveniles being tried as adults in the world of criminal justice has usually been an object of controversy. Some agree that an adolescent who commits a serious crime like murder deserves to be penalized exactly like an adult; while others declare that a minor should not face the same punishment as an adult. However, no matter how severe or appalling a crime may be, juveniles should not be tried as adults; the reason being that everyone should be granted the chance to learn from their mistakes. Juveniles should not be punished as adults, simply because they biologically distinct from adults. Teenagers are the midsection between children and adults.…
