Many people believe that it is not right to allow infants to live in the prison because it like making the children pay for the crimes of the mother. By living in the prison nursery, the child is being incarcerated along with the mother (JBARA, 2012). When the consequences of living on the inside versus living on the outside are weighed against each other the risks to the infant are much greater if they are raised outside the prison walls. When the results came back positive for drugs the police were called and the women were arrested either while they were pregnant or soon after they had their baby (Kunakemakorn, 2010). The police had to work with the hospital staff to bring the cases against these women. The actions performed by both the hospital and the police contained many mistakes and were not legal. While using drugs while pregnant is dangerous to the fetus, it is illegal to perform drug tests on random patients without their permission. If the patient had already been arrested the drug testing could be performed. The police need to protect the rights of the pregnant woman from the begininnig. By not following the law they are not only violating the rights of the women, they are also building mistrust that will continue into these women’s
