The 38yo truck driver was within the course and scope of employment during the collision with BCI’s vehicle. He is claiming injuries to his back, left knee and neck as a result of the collision. Although we have confirmed the claimant is being considered for a disability rating, the worker’s compensation adjuster will not disclose specified injuries and treatment information without a signed medical authorization.

Claimant is symptomatic nearly two years post-accident. Therefore, we anticipate that claimant will pursue additional medical treatment beyond worker’s compensation. We expect claimant to present a claim for past and future earning capacity if a disability rating is assigned. I agree with reserves of $80,000 at this time.

    Espinoza stated that on the claimant’s LDW 11-25-2015, she was told by Supervisor Navarrete that he had information from the claimant showing that he had a pre-existing industrial back injury.
