As far as the legal defensibility of UPS’s driver evaluation program goes I would rate it a 10. For example, we can start off with the job analysis portion. It’s the supervisor’s job to make sure job analysis is adequate for the employees in this company. The supervisor has demonstrated this portion in keeping tabs on the driver’s performance. Next, you have the behavior-oriented analysis portion. During the behavior-oriented analysis for UPS the drivers seem to be well adjusted since the PDA’s have been making their jobs easier. Following is the specific written instructions that UPS has provided.
