1. Creation of a program to reduce usage of cigarettes and tobacco products to minors.
2. Requires all tobacco retailers to post a notice at each register asserting that the sale of cigarettes and tobacco products to minors is illegal and subject to penalization. Also requires retailer to request identification from any individual who appears to be under the age of 18.

Regulation of electronic cigarettes will negatively impact the market for electronic cigarettes. Retailers specializing in electronic cigarettes are likely to see a significant drop in sales. Additionally, subjecting electronic cigarettes to the same regulations as tobacco products may negatively impact the electronic cigarettes brand as a tobacco alternative.
3. Section 23 308 (a) asserts 25 percent of all penalties collected as a result of SB-24 will go towards financing the program administration. However, as electronic cigarettes are a growing market, the funding from penalties may not adequately address the needed regulatory capacity to monitor additional retailers and distributors. Without needed capacity, the Department of Health may not be equipped to maximize reduction of illegal usage of electronic cigarettes amongst minors.
4. The California Department of Public Health creates yearly reports regarding tobacco use and promotion in California . In the 2013 report, “State Health Officers Report on Tobacco Use and Promotion in California”, the Department of Public Health cited the current usage for emerging tobacco products.
