Summary Of Jose Rojano's Case

Jose Rojano was hired with Havasu Glass with the mutual understanding that after his training period he would be able to work independently. When it was appropriate Jose was left to work alone. His Supervisor Clay Smith would spend 2 days a week with Jose in Yuma and the rest of the week at the Lake Havasu office. There came a point in time that Jose’s work performance was not satisfactory.

Clay had many verbal conversations with Jose in regards to not completing his daily work schedule, leaving work early, and setting personal appointments on company time. Verbal conversations didn’t resolve the situation so it became necessary in the fall of 2016 to send another installer to Yuma from the Lake Havasu location. Jose then began to become disrespectful by being aggressive and talking badly in Spanish about his boss Clay Smith, in on job sites, while Clay was standing next to him.

We received notice from the Department of Economic Security in January 2017 (see our protest for that date attached) that Mr. Rojano was filing to receive un-employment benefits although he was still employed with us. This was disturbing because it had become his habit to be late, call off, or leave early.

He told his supervisor Travis Smith he would be in after that (by 10:00 AM). He called a few more times and told Travis he had other situations to deal with but he would be in to work. After the first part of the day was gone he then informed Travis that you would just be taking the day off. This is just an example of the many concerning excuses he had given for calling off.
