Insight to The Criminal Justice System
Guenther’s Views In a time before what the world has become today, Guenther had many philosophies and ideas on how the criminal justice system should be ran. Guenther believed in 1976 that the system was more “unfair, harsh, and biased” and could seen more as a criminal processing system. What he found was that it the system is just and true, there were several incidents he went through that led him to predicating the current future and the on going reoccurrences in times before. Packer insisted the ideals in the due process model was a counter proposal to the crime control model. When looking at these models he created, are views towards the criminal justice system should be in pertaining to the true values and the general process. When looking at both of the models they tend to be correct in their overall description because of the core principles a criminal justice process should offer. “Two poles and a line in between” was a saying that described his ideas. What Guenther was able to identify was that people were been recognized by on their ethnicity, class and race. Which correlated with policing and prosecution. In dealing with the Racial Identity Theory (Helms, 1995), an ongoing issue had began to start to occur with people being accused of crimes based on their symbolic assailants of people who had committed them prior. Another idea Guenther came to terms with was that it was a way to drive policing only based on the different cultural socialization and stereotypes. A key separation in people and there classes they fell into was the creation of socialization and the suburban living people. As we know the suburban area living will generally be your middle class and upper class people. What we saw was the development of lower income and poverty driven people heading to the inner city where crime rate would increase with drugs, thieves and any inner city crimes that occur. And with this migration to the inner city we police have more of a central focus of these low-income areas, which would lead to higher crime rates to the African American culture. With high crime rate in inner cities we saw the 200 billion budgets be utilized by law enforcement using 60% of the budget when a portion of the money could have gone to other organizations.
