Kevin Latham was charged with a single count of committing First Degree Residential Burglary (Statement of the case P.1). Latham was convicted in 2004 due to an attempted robbery. Appellant denied all allegations and plead not guilty in court.
There is a lot of evidence that shows Appellant is guilty of burglary. The crime started on January 21, 2013. Bernadette Scario Airuyuwa was leaving her house in Palmdale to go to Africa. She did not give anyone permission to enter her home except for her son James Lenaris. When Bernadette returned she noticed things were missing (Statement of Facts P. 3-4).
