Summary: Bill Cannot Sue Scoundrel In Court Cases

1. Bill cannot sue Scoundrel in court because it specifically states in the CCR section 11.6, all parties agree to waive their right to have their claim resolved by a court. Additionally, explicit types of ADR and steps must be followed when resolving any conflicts.
2. In the documents we received, there are three different types of ADR provided. Negotiation between the Claimant and Respondent, mediation and binding arbitration.
3. We are not able to skip to mediation. The contract states negotiations must take place for thirty days after the date of the Claim Notice, unless a longer period is agreed upon between both parties before mediation can be attempted.
4. Arbitration is included in the contract, but we cannot appeal if we don’t agree
