The population of Indigenous Australians living in Australia is predicted to be approximately 650,000 in 2016, comprising of approximately 2.7% of the total population of Australia (ABS, 2014). Nevertheless, Indigenous Australian youth are consistently over-represented in the CJS, as both offenders and victims (Carpenter and Ball, 2012, 91). A report published by Amnesty International, A Brighter Tomorrow, found that although Indigenous youth only represent 5% of Australia’s population of 10-17 year olds, they make up 59% of their detention. This means that Indigenous youth are 25 times more likely than non-Indigenous youth to be imprisoned (Amnesty International, 2015). These statistics demonstrate disadvantage as more Indigenous youth are in juvenile detention and less are attending school, setting them behind non-Indigenous students academically and thus leading them to lesser opportunities to succeed in life, that is, life chances.…
An approach to reducing the over-representation of Indigenous children and adults in the criminal justice system (Steering Committee for the Review of Government Service Provision, 2009), justice reinvestment requires broader and holistic consideration of what contributes to crime. Over-representation is considered a product of disadvantage which requires intervention at a community wide level (Australian Human Rights Commission, 2009). In June 2013, Aboriginal people represented 27 percent of the total prison population, despite comprising only around 3 percent of Australia’s population. Aboriginal prisoner numbers have been increasing, although at a reduced rate recently, with an increase of 10 percent between 2008 and 2009. Slowing to only 1 percent growth between 2010 and 2011, and rising to 5.6 percent growth between 2012 and 2013 (ABS, Prisoners in Australia, 2013). In order to avoid this overrepresentation of Aboriginal people in the criminal justice system, alternative systems should be established, and help reduce recidivism rates. During questioning of an aboriginal suspect, an officer can be assisted by an aboriginal elder whose participation allows cultural issues to be taken into account in determining whether the suspect truly committed the offence and to advise the officers on appropriate cultural issues.…
In 1991 the Canadian Federal Government introduced the First Nations Policing Program as an effort to help with the overrepresentation of Aboriginals in the Canadian Justice System. This program allows the establishment of Aboriginal administered police services in Canada on Aboriginal territories. The Aboriginal police are funded by Public Safety Canada. Public Safety Canada mentions that while Aboriginals face much higher crime rates do to their socio-economic status, poorer education and poorer health outcomes the effects of Aboriginal led policing have had a measurable and positive impact in areas which they operate. In the Frontline documentary Policing the Police, writer and historian Jelani Cobb investigates the problems facing the Newark Police department. The film specifically follows the gang unit whose main focus is getting guns off the street. In the background Cobb explains what he is witnessing and what he’s learning from it. Cobb explains how the police can only stop people with legal justification, but 75% of the time there was no legal justification. Racial stereotypes are making it so some Aboriginal women have distrust in Canadian authorities, in fear that they will not take their cases as seriously.
