With this being an ongoing issue a number of federal and state laws were put into affect to make the inquiring of certain questions illegal. Title IX of the Education Amendment in 1972 and Title VII of the Civil Rights Act in 1964 are two federal laws that prohibit these practices.
In the case Stone v. Graham when a Kentucky statue required the posting of a copy of the Ten Commandments which was purchased with private donations. The donations stated each public classroom was required to display copies of the Ten Commandments. Even though the statues were purchased with private funds the statue requiring this type of posting was declared unconstitutional. Under the three part Lemon test, the court concluded the posting failed under part of the test in that it lacked a secular purpose.
