This memo argues that the outcome of the McDonald case is unfair. I will argue that the compensatory damages are fair but the punitive damages are not because Mrs. Leibeck was 20% at fault. Stella Leibeck was a 79 year old woman who scolded that McDonald`s fast food company because she got badly burned with a hot coffee that she bought at a local restaurant. This case became quite popular and was in all news. Mrs. Leibek should have never left her coffee cup open. In my opinion, all customers who consume coffee know that it will be rather hot, about 180 to 190 degrees Fahrenheit. That is why, it was her mistake for not having the responsibility to take care of her coffee. It is always hot and people should be precautious while drinking …show more content…
In my opinion McDonald company has the culpability for not telling its customers to be precautious about their coffee as it is really hot. Coffee should never reach the temperature of 190 degrees Fahrenheit and it should never be given to customers in such a way. Susan Saladoff, the author of FAQ about the McDonald`s Coffee Case finds that third degree burns do not heal without skin grafting, debridement and whirlpool treatments that cost tens of thousands of dollars and result in permanent disfigurement, extreme pain and disability of the victim for many months and even years. That is why, I agree with the amount of money she was given and state that $160,000 was a fair sum. Mrs. Leibeck was injured so badly that she had to stay hospitalized for several days. Additionally, the doctor told her that she would be disabled for about two years to get better. The McDonald company has known about this risk for many years however it did nothing to find the solution to the problem with hot coffee. That is why, now they are paying a great sum of money, instead of devoting some much smaller sum to finding solution to this
