Stella Leibecks Argumentative Essay

This memo argues that the outcome of the McDonald case is unfair. I will argue that the compensatory damages are fair but the punitive damages are not because Mrs. Leibeck was 20% at fault. Stella Leibeck was a 79 year old woman who scolded that McDonald`s fast food company because she got badly burned with a hot coffee that she bought at a local restaurant. This case became quite popular and was in all news. Mrs. Leibek should have never left her coffee cup open. In my opinion, all customers who consume coffee know that it will be rather hot, about 180 to 190 degrees Fahrenheit. That is why, it was her mistake for not having the responsibility to take care of her coffee. It is always hot and people should be precautious while drinking …show more content…
In my opinion McDonald company has the culpability for not telling its customers to be precautious about their coffee as it is really hot. Coffee should never reach the temperature of 190 degrees Fahrenheit and it should never be given to customers in such a way. Susan Saladoff, the author of FAQ about the McDonald`s Coffee Case finds that third degree burns do not heal without skin grafting, debridement and whirlpool treatments that cost tens of thousands of dollars and result in permanent disfigurement, extreme pain and disability of the victim for many months and even years. That is why, I agree with the amount of money she was given and state that $160,000 was a fair sum. Mrs. Leibeck was injured so badly that she had to stay hospitalized for several days. Additionally, the doctor told her that she would be disabled for about two years to get better. The McDonald company has known about this risk for many years however it did nothing to find the solution to the problem with hot coffee. That is why, now they are paying a great sum of money, instead of devoting some much smaller sum to finding solution to this

I haven’t heard this case before, however as I saw the headline about a woman getting money for spilling a hot coffee on her lap, I was quite confused how on earth would someone sue a company for their own alleged negligence? That’s because I did spill a cup of hot water on my lap, (the exact temperature is unknown, though) and I only suffered from my skin getting some red spots around the affected area. However, after seeing the picture of the burns, I do think it was not such a trivial litigation considering the harm…

In a school in Detroit a teacher by the name of Tiffani Eaton tried to stop a fight between two students by hitting both of them with a broom. Because of her actions the school fired her, the students were suspended. In my opinion her punishment was unjustified, although I can understand the other side of the coin. She did cause the students physically and mentally harm. As well as brook the schools policy by not getting security and hitting a student.…

Social worker and reformer Florence Kelly, strived to make a mark on the pitiful and unfair working condition that were present through the early nineteen hundreds. Through the use of a creative and elaborate speech Kelly forced the women of Philadelphia to stand up for children’s rights and form the National American Woman Suffrage Association. In order for her voice to be heard Kelly conjured a speech with a wonderful flow, full of pathos and empathy, as well as brilliant word choice and a striking message to the listener. Without these underlying aspects her argument could have been overlooked, or diminished as a simple radical, or protester of child labor, but due to these aspects Kelly’s speech inspired women across the nation.…

The governor of Connecticut recently proposed raising the age of juvenile jurisdiction to twenty-one as a way of keeping young offenders out of incarceration. In the ensuing debates on whether this is a good idea or not, experts also disputed the appropriate cut off age for juvenile court. Carmen Daugherty, in her article “No One Younger Than 18 Should Be Tried as an Adult,” suggests eighteen as the age limit. She attempts to persuade readers that the practice of trying, sentencing, and incarcerating youth under eighteen in the adult criminal justice system should be terminated as it fails to meet the needs of adolescents. Daugherty appeals to logos to support her claim.…

Many times have people made decisions in their lives that resulted in a punishment that may seem just or unjust. Although all carried out for different reasons, people’s crimes result in somewhat similar outcomes. With that said, the circumstances surrounding a crime are conditions that should be considered when sentencing a person in court, but they shouldn't be used as an excuse to mitigate a case down to nothing. In the case of Carl Lee Hailey, I think his mindset is essential to look at and is important enough to take into consideration when charging him for the crimes he committed; it is also essential to keep things lawful and present justice to all.…

ed he “would rather die a thousand deaths” than surrender to Grant (Winik 168). Plus, when you take into consideration that the Confederate president, Jefferson Davis, had already supported the idea of guerilla warfare, it is obvious that Alexander’s plan was a tempting option from Lee’s point of view. Even with all the benefits guerilla warfare would have had for Lee, he still decided against it, largely due to his sense of duty to the country. Lee was the hero of the Confederates, and had he accepted the idea of guerilla warfare, many others resisting the Union would have followed him.…
