The criminal charges were heard by a judge and jury where Mr. Evans gained a criminal conviction for the charges that he faced in the trial. The criminal conviction of Mr. Evans lead to his appeal to the State of Iowa Appeals court to evaluate the case as it relates to the state statute for harassment and stalking (Brody and Acker, 2010).
When at trial the prosecutor was able to show that the harassment of Ms. Arnold started when the two meet in college during the year of 1998 with Mr. Evans asking the victim to allow him to take photos of her bare feet and legs (Brody and Acker, 2010). A counter argument to ‘State v. Black’ would of course be the case of ‘State v. Oliver.’ Yet, this case should not apply to my client nor should it have an effect on the outcome of his case. Other than the fact that both of the husbands in each case disciplined their wives, there are no similarities to be drawn. Yes, both husbands did hit their significant others, but this argument is a weak one, as one husband (Richard Oliver) was far crueler, inflicted major physical damage and perhaps had ill intentions. “One of the witnesses swore he stuck as hard as he could.…

My role is important to this case because I was a witness when the robbery happened at the bank. Even if the gun was not loaded, he was still carrying a known lethal weapon. Therefore, Patrick Johnson put the bank teller and everyone in fear during the robbery. As a gun expert, I would not know if a gun is loaded or not. Therefore, if someone pointed a gun to me, I would definitely be scared and would not resist orders.…

As mental health and forensic experts continue to study the phenomenon of stalking, we will begin to get a better picture of just what prompts stalkers to engage in their campaigns of harassment, terror, and violence. Gregor Krause, Stalking: The Crime of the Nineties, Albuquerque Mag. , Jan. 1993, at p. 26. The assessment, investigation, prosecution, and defense of stalking cases is a most complex and challenging process. Often, victims suffer a host of indignities before, during, and after law enforcement intervention.…

Predatory stalkers are one of the more sinister types as their stalking has the duel purpose of gaining power and control over the victim but can be seen also as a precursor to more insidious actions such as rape or sexual assault. While this stalker can target either people they are familiar with or complete strangers their motivations are always sexual gratification, with many victims reported instances of being watched by the stalker, receiving explicit phone calls, exhibitionism, fetishism, and voyeurism (Sapac, 2015). While these types of stalkers generally stalk for shorter period than others they also have a high probability of becoming violent with their target the longer the stalking goes on for. An intimacy seeker has the desire…

In his book, Constitution In Exile, Judge Andrew Napolitano wrote: “Rooted in a Natural Law mind set, the Supreme Court clearly viewed the protection of the freedo of contract as a god-given right. So much so that the Lochner case, in which, the Court fully articulated the 1905 doctrine of liberty of contract came to define the time. Firmly, the Court established that the ‘freedom, or liberty of contract was a basic, fundamental right protected by the liberty and property provisions of the Due Process Clause of the fifth and Fourteenth Amendments’. As a natural right freedom of contract received the greatest judiciaal protection by the Constitution.” –p 108.…

    Stalking Behavior

The legal construct of stalking has been a point of academic and societal controversy in part because what is considered illegal stalking behavior, such as persistent attempts at communication and expressions of desire or commitment, is often difficult to distinguish from normal courtship processes (Anderson, 2009; Cupach & Spitzberg, 2005, Dunn, 2002; Emerson, Ferris, &Gardner, 1998). It is likely that human societies have always experienced forms of stalking(Dan & Kornreich, 2000; Finch, 2001; Kamir, 2001). Such overlaps between the cultural constructions of courtship and the prohibitions of threatening and harassing activities represent a problematic intersection. There has been reluctance on the part of the criminal justice system to view stalking as a serious issue (Kim & Spitzberg, 2012; Spitzberg, 2002a); and when the system does confront it, efforts seem “more focused on physical rather than psychological harm, thus leading to the minimization of the terror that stalking causes as well as stalking as a crime” (Logan & Walker, 2010, p.…

Though there have been any improvements to the legal policies of stalking and intimate-partner violence they still correlate together. For example, about 60 percent of intimate-partner violence victims have at one point in time been stalked by their partner, (National Institute of Justice, 2012). Majority of femicides are correlated with stalking.…
