State of Indraprastha v. Chitvan
In March 2010, two college students from different religious communities named Aisha and Chitvan fell in love. They were both aged 19 years old at the time. Over the next few years they decided to get married once they got financially independent. Being citizens of Aryavarta, wherein inter-religious marriages are legal but not socially prevalent, they decided to keep their relationship a secret from their friends and family. The couple decided to approach their families after they became financially independent.

Although Chitvan and Aisha had supported each other in their professional endeavours so far, some differences arose between the couple in 2017. The work pressure at Aisha’s firm and Chitvan’s unemployment

She immediately sent back the following text via Whatsapp:

Thereafter, Aisha’s phone ran out of battery. Chitvan, who had been very distressed with the way their relationship had been going for the past few months, started suspecting that Aisha was avoiding him. All kinds of thoughts ran through his head. He wrote in his blog that night that he suspected that Aisha was seeing someone else, probably, someone her parents had introduced her to. He also wrote that he had texted her back immediately, but there was no reply, he tried calling her, but her phone was switched off. The Whatsapp texts he referred to are as follows:

The next morning, Chitvan waited for Aisha outside her apartment building. At 07:45 hrs, a car was rented over an app by from Chitvan’s phone. The records show that the rented car plied on that trip from Aisha’s apartment to her workplace. The taxi-driver Bikram (PW 1) gave the following statement (translated from Hindi):
“I got a booking through my rental app from a man named Chitvan at 07:45 hrs on the 8th of February, 2018. He got in along with a Madam. They kept arguing and yelling at each other all the way to the destination. I could not understand what they were talking about because they were speaking in

When her colleagues and flatmates tried to contact her, the automated answer was that to the effect that her phone number was switched off. Her flatmates registered a missing person’s case with the Indraprastha Central Police Station (which had jurisdiction over the residential area as well as the workplace of Aisha) on the 10th of February, 2018. After preliminary inquiries and on the basis of tracing the frequently called numbers from Aisha’s phone, the police tracked down Chitvan. Sub Inspector Motilal (PW 2) and Head Constable Ghanshyam (PW 3) of the Indraprastha Police met Chitvan at his coaching centre residential room to ask him about the whereabouts of Aisha. Chitvan was found in an inebriated state in his room and the song November Rain was found playing on a loop in his music system. On being asked about the whereabouts of Aisha, he stated as follows to PW-2, in the presence of Kinjal (PW-4) and Kunal (PW-5) two of his fellow students from the coaching
