Mrs. Fibich made similar statements during her meetings with Anita Killea on February 24, 2015 stating that SLHS is not doing its job because special education isn’t fixing him. (See Exhibit XX)
Michael’s ARD committee developed educational programs to address Michael’s unique needs in all areas of suspected disability. Fibich notified Mr. Cooper on October 21, 2015 via email that Michael’s pediatric neurologist made changes to Michael’s stimulant medication (Focalin) but was unwilling to prescribe Michael any mediation for sleep other than an over the counter melatonin. (See Exhibit XX) The District remained in consistent contact with Mrs. Fibich as she notified Michael’s teachers and case carrier about his sleep patterns and his teachers made accommodations and schedule modifications to assist Michael in completing assignments, quizzes, and test. As described in the email from Cheryl Raschilla, on April 12, 2015 the District provided Mrs. Fibich a consent to invite outside agencies seeking consent to invite DARS to Michael’s May 2015 annual ARD. (See Exhibit XX) 7Mrs. Fibich failed to return the consent for and therefore, the District was unable to invite DARS to Michael’s 2015 annual ARD due to state and federal privacy laws. (See Exhibit XX)
Michael’s special education case carrier, David Cooper, sent Mrs. Fibich a letter dated August 2015 enclosing a “Consent to Invite Outside Agency” form and transition survey asking that Mrs. Fibich complete, sign, and return the forms. (See Exhibit XX) Mrs. Fibich did not respond to the August 2015 letter until March 1, 2016 when she returned the completed the transition survey and an incomplete Consent to Invite Outside Agency form. With due diligence, on March 3, 2016, for the third time, the District provided Mrs. Fibich a Consent to Invite Outside Agency form seeking her consent to invite DARS.
