Shoplifter Case Study

I would inform my manager that it is against the law to hold someone against their will. If I stop the customer while exiting the dressing room, this will give the shoplifter the right to sue the company for wrongful search and seizure. The customer can also sue for civil and criminal liability for false imprisonment. Until the person is found guilty of the crime, no pictures or announcements can be made informing others that the individual is a shoplifter. The shoplifter can sue for defamation of characters if those accusations are proven to be false.
The proper way to approach a shoplifter is to first establish a probabble cause. The shoplifter will need to be seen with the merchandise, as well as seen concealing it. The observer must
