Assemblywomen Melissa Melendez introduced a new bill AB 403 last year, advocating for better protection for legislative staffers and lobbyists who report illegal activities in workspace, especially sexual harassment. The bill has failed for four years consecutively due to delay by the Appropriations Committee with unknown reason. This time, Meledez is coming back with full support – 13 California Senators co-authored the bill with her, with over 140 open letters showing support.

Although legislative staffers are already under protection by the California Whistleblower Protection Act (CWPA), passing this bill will add extra penalty who retaliates whistleblowers – they may be fined up to ten thousand dollars with a maximum of one-year imprisonment.

We’ve seen too many astonishing news of sexual harassment among public figures, in Government, in Hollywood, nearly every corner of our state. We have laws against sexual harassment in some of those fields, but it’s time for us to regulate it in state Capitol.

State legislators who has been advocating for equal rights, equal treatment for employers and minorities, should also practice such equality in their own workplace. As said by Meledez, “I see no reason why this law hasn’t been made to the floor”. It’s been four years of delay and failure, it’s time for us to gather our voices and advocate for passing the bill.

Under Title VII, sexual harassment, like racial and ethnic harassment, is illegal since it constitutes discrimination with respect to a person’s conditions of employment (Bernadin, 2003). Moreover, in the Oncale v. Sundowners Offshore, Inc. (1998) decision, the Supreme Court made it extremely clear that Title VII’s prohibition on sexual harassment protects men as well as women (Robinson and Frink, 2002). Usually, sexual harassment happened to the victim is because of her or his sex. For example, a female employer could become the target of harassment from a heterosexual male supervisor because she is a female. If the employee is a male, he is not likely to be the heterosexual male supervisor’s target.…

New York’s pay equity law closely resembles the new provisions in California’s law with a few key differences in the scope of comparison employees can make when bringing claims and available affirmative defenses. The feminist movement is a prevalent force across the nation and is fighting for equal rights for women. One of the main attributes to women not being treated the same as a man is the societal roles that are still in place for both. The only way to move away from gender inequality is to try and stop every instance of it from occurring and to not let it prevail in society. Donald Trump’s rhetoric used to objectify and defame women is the means for the perpetuation of gender inequality in the United States. From the beginning of time, humans have struggled in deciding what rights certain groups should or should not have, and, slowly, everyone started to be set upon the same plane.…
