When federal cases are tried, the length of imprisonment is determined by the United States Sentencing Commission sentencing table (Cite2). The defendant is given a base offense level given the nature of crime itself and then additional levels, known as enhancements, can be added in addition to their base offense level. For example, the base offense level for trespassing is a four, while kidnapping has a base offense level of thirty-two. After all is totaled together, the defendant will receive their Total Offense Level which determines their advised imprisonment time, which is given in the form of months based off of the table.
