Seniority Layoff

Seniority-based layoff implies that an employee who was recently hired become the first to be laid off. Ideally, layoff based on seniority hardly raise questions about age discrimination (because it rewards individuals who have stayed longer with the company and they cannot be the first to be laid off, but those with short tenure), nevertheless, this methods has to be examined and tested for adverse effects against certain protected classes of employees. In Sarah’s scenario, seniority layoff does not apply. However, if in her position they were a number of employees with substantially equal abilities, knowledge and skills, then, this implied that layoff had to be determined in the reverse of seniority she could have fallen victim (Krill, 2015;
