In my Judgement the most important argument made by Sunstein was The Second Bill of Rights. A decade before the enactment of a general civil law, Roosevelt insisted on an antidiscrimination principle. (Page13) Then he had listed the eight most important relevant rights. Number one was the right to a useful and remunerative job in the industries or shops or farms or mines of the nations. At that time of period African Americans were discriminated as well as the women when it came to jobs. This right indicated them the right to work. Throughout American history, the meaning of the Constitution is often very different from what it was even two decades before During the World War II in 1900, it was clear that the Constitution permitted racial segregation. In 1930, the Constitution allowed the government to suppress political dissent if it had a bad or dangerous tendency. In 1910, the Constitution prohibited maximum hour and minimum wage laws. In 1960, the Constitution permitted sex discrimination. Which was the unfair treatment to women and gender identification. In 1960, the constitution allowed the government to regulate commercial speech, which was not protected by the free speech principle. Franklin Delano Roosevelt was a very powerful leader as a President. He knew there needed to be a change and he stood up for it. Sunstein cleverly states on page 14 indicating the sick person as the United States and the Doctor as Roosevelt. He describes the United States suffering from a grave internal disorder. And people thought America as a nation would not live due to the bad shape it was in. Old Doc New Deal partnered up with Dr. Win the War to take care of the United States.
