Animals cannot have rights because they do not contribute to the community as humans do. They aren’t like humans waiting on to kill one another for food. Animals’ betrayal one another to be able to feed themselves and still would be killed off. If a fox has to hunt a chicken for food, it won’t be stopped. For a chicken to have rights, they’d have to consent and if you ask for a chicken to consent, you’ll receive a chirp instead of an agreement.
On the other hand, Regan argues a whole different point of view from Scruton, he speaks for animals. Regan believes animals inherent value because their “sentient”. Scruton speaks of the unequal status that would happen when he writes about his responses of the animals eating one another. It wouldn’t stop the course of nature killing the animals. Humans would have to deal with the situation of the over population of the animal not killed to feed people. There would not be a spot for animals to live, and if they take over cities, where would we live? We would have to fit them somewhere else but the zoo. They’d take over the human population and property. Everything for an animal to live in its habitat would take over land to recreate their home while we lose ours.
Furthermore, Scruton believes the moral status of animal rights is they have unequal status. “Creatures who are by nature incapable of entering into this dialogue have neither rights nor duties nor personality.” If they were to have rights than there would be requirements for consents of an animals rights towards humans.
