“Gentlemen of the jury, thank you for listening so intently to this trial. I know you care about our community, and that you will bring justice to the end of this sad story. Mr. Baumer is innocent. He worked for months growing closer to this man and putting all of their differences aside. He was bullied by Slade and now he is being tortured by Slade even after his death.” “Slade was responsible for his own death, He poisoned himself, it was an accidental suicide. Now I am here today to finally relieve the continuous torture that Slade keeps bringing onto Mr. Baumer. Even though Slade continually called him racial slurs, beat him up, embarrassed him, and wouldn’t pay his bills, he still gave him another chance because he was a kind, forgiving …show more content…
They are wrong! There are many reasons to buy quantities that large. For example it was a bargain, engine fuels, adhesive remover, gas line antifreeze, and disinfectant spray. These are just a few example of why you would need to buy large quantities. Mr. Baumer would sell these to larger companies, make money, and plus he also got a bargain. The other side may also argue saying that Mr. Baumer knew that Slade could read. They would have a quote supporting it also, ‘He can’t even read.’ (Page 239) Al said this in the store that Mr. Baumer owned. Here it proves that Mr. Baumer knew that Slade could not read. But, why is everybody assuming that Slade ever died from drinking the wood alcohol? We all assumed it because we know Slade is a heavy drinker. We assumed it because that's what freighters do in the cold isn’t it? Who knows? We do not know whether Slade could have died from even drinking it. If he would have died from drinking that much beer anyways. There are other reasons why Slade could have died but everybody immediately assumed that it was a murder. He could have frozen to death, imagine it being forty six degrees below zero! Mr. Baumer is innocent and if you want to do the right thing, it is not going to be imprisoning an innocent man who is still being tortured by a dead

Ms. Bordenkecher’s reliance upon materials outside the pleadings to argue that Plaintiffs’ claims are unsustainable demonstrate that Defendant seeks summary judgment from this Court, despite its claim to the contrary. Under the Maryland rules, when a defendant files a motion to dismiss for failure to state a claim, and matters outside the pleadings are presented to and considered by the court, “the motion shall be treated as one for summary judgment and disposed of as provided in Rule 2-501.” MD. RULE 2-322(c) (emphasis added). The reason for this rule is that with a motion to dismiss the court considers only the allegations in the complaint to determine if the facts alleged by the plaintiff sufficiently state a recognized cause of action.…
