One of the preeminent modern libertarian is Robert Nozick. His most famous writing is Anarchy, State, and Utopia in 1974 which holds a negative conception of liberty, or the freedom from interference by other people. Negative liberty is the absence of any external limits to what you desire. The state has no right to interfere with economic or social actions of citizens unless it is protecting property rights, stopping aggression against persons or righting past injustices. Nozick believes that the minimalist state is the most extensive state that can be justified with state power having to be morally legitimate to have any bearing on society. Citizens should leave each other alone, and not try to impose their morals or rules upon one another (Sandel pg. 60). Self-ownership is the foundation for libertarians and Nozick as well. He states “that each human being is the morally rightful owner of his own person and powers” (Cohen pg. 89). A person does own their body and the labor that they can produce with it. I feel that prostitution is no different as if I hired somebody to work on my car or paint my house. We agree on a service with a price, I pay for it and receive the agreed service. Whoever participates in this process knows what they are doing as well as what is required from them before the work takes place. They are not under duress and can refuse a job, the same as any other profession or service can tell you no. There are obviously problems with prostitution that need to be worked out and addressed, but by controlling all of these issues correctly, this can be a safe, regulated and taxed industry that can improve society overall. All industries have their issues, but regulating them is far better than ignoring the problems and not addressing the aspects that are illegal and should be wiped
