On March 27, 2017, Reno Police Department officers were dispatched to a report of several people breaking into an apartment. As they were arriving, Dispatch informed the officers the victims had reported they had been pepper sprayed and someone on the scene had a gun.

When the officers arrived, they discovered three people standing near a vehicle. One of three was later identified as Cesilia Navarro-Gabriel, the co-defendant. She approached the officers stating she had been beaten up by the people in the apartment. Her hands were bloody and she was very agitated, as a safety precaution she was placed in handcuffs and searched. During the search, an used aerosol can of pepper spray was found. The officer asked her if she had pepper sprayed anyone, the defendant responded she had while involved in a fight.

A male subject found in the driver’s seat of the vehicle was detained. The other male subject, later identified as the co-offender Cappi Navarro fled the scene when the officers drove up. The remaining subject stated he and Cappi Navarro came to the area after Navarro’s sister, Cesilia Navarro-Gabriel, called them and asked for them to come to the apartment building.

All of the victims had visible signs of being around pepper spray, their eye was swollen and had redness around them. Vicitm #1 stated the victims were in the apartment when they heard the front window break and banging on the front door. He said after the window broke the defendant and another female, identified as Daisy Preciado, the defendant, entered the apartment and started pepper spraying all of the adults and children. Preciado battered Victim #1 with a metal broom handle causing an injury to his right
