Right To Be Forgotten

The Right to Be Forgotten was passed in Europe in the last few years. Jeffrey Rosen, a professor of law, discusses “The Right to Be Forgotten.” This article shows three categories of the law explained by Peter Fleischer. The first category is the least controversial; if people put their pictures on the Facebook, they can easily take them down. In Europe, The Right to Be Forgotten protects the secret of each individual on the social network. The second category has more debates that people copy and re-post photos on their individual sites, but they decline and cannot be found on Facebook. Social media is a “knife” because it can make people become better or worst in their life, especially in business. Business can lead to triumph in reality, and The Right to Be forgotten can help remove one’s financial situation from the public. For example, the article “Op-Ed: BBC vs Google over 'the right to be forgotten'” by Tim Sandle, Mario Costeja González is a lawyer, and he had unpaid debt from his business; then his property was used for auction, which can negatively influence his future and reputation. The Court of Justice of the European Union helps him overcome the difficulties in his business by ordering Google to remove the information from internet. On the contrary, In America, we do not have the private protection, we only have the First Amendment that agrees citizen’s freedom of speech. Europeans support The Right to Be Forgotten while American has the First Amendment to protect the right in freedom of speech. People have freedom to write, sing, and express themselves. However, the new law control on free of speech avoids these social’s evil such as defamation, child pornography, fight work, and copyright. For instance, in Europe, Mr. McKeogh started to go against Google, Facebook and Yahoo after taxi driver was put in the video that displayed someone who looked similar to him. When people post pictures or information of others without their permissions, the action affects invasion of privacy, and it can influences one’s life forever in some cases. In this case, Mr.McKeogh was able to clear all the information on the websites, and people could no longer find that links because European Union had a data protection to people who demanded for help to erase their online histories (Danny Hakim). Meanwhile in America, right freedom of speech protect by the First Amendment. People post picture or individual information upload on the internet. Then, they want to remove them, but American deny The Right to Be Forgotten.
