Regina Simon Gittany Case Study

In criminal law, when a person commits an act or fails to act in a certain way, which results in death of another, the former may be charged with what is referred to murder. There are different classifications of homicide, referred to as degrees. There is first degree murder, in which case the circumstances clearly show a premeditated or aforethought intent to end the life of another which attracts a death sentence or life imprisonment. Second degree murder, is a lesser degree form of homicide. In this case, death occurs to a person, through commission of another act, causing death of another person, though in this case there is no intent to cause death (Mcphedran S & Baker J. 2012). In the case of Regina Simon Gittany, the accused was charged with murder of his fiancé Lisa Cecilia Harnum. The murder was committed on 30 th July 2011 at an apartment where the couple lived on the 15th floor of the apartment known as The Hyde, along Liverpool Street in Sydney. The Crown accused Mr.
Gittany of killing his fiancé by throwing her off the balcony of the apartment, from the 15 th floor. Lisa Harnum is believed to have died in an instant from the injuries sustained from the fall. This is contrary to the usual patterns and trends of homicides where the perpetrators are usually not attached to any straight religion or belong to socially unaccepted cults. Mr. Gittany comes from a background of family that can simply be described as a normal family. It would be abnormal family where there are cases of child abuse or neglect subjecting children to brutal society and eventually criminal
