The justice system is always meant to give both the plaintiffs and the defendants’ justice by being impartial when judgments are being delivered. The judgments of cases of similar strengths of evidence that go to the courts and are from different racial divide should always be treated in the same way without any form of prejudice. It is important for the society to understand that no one chooses the race in which he or she is born. It is therefore paramount for people to always live in peace and harmony in order for political, economic and social developments to occur. Racial discrimination in the court systems only serve to divide the people and it is not good for the growth of the society. But this kind of racial discrimination happens because we are not able to see that the idea of identity has been socially constructed. The definition of "culture" is linked to the definition of "identity". There is therefore the need for a proper way of dealing with the two social ills in order for everyone to understand that they have been treated well. The issue of death penalty has been used for a very long time in the courts of law to punish those who have committed heinous crimes. It is important to note that the punishments are always not wrong if the right procedures are followed. Many African-Americans are put on the death penalty because of their skin color skin and the crime that they committed is put on the back burner. The idea of race is “an ideological construct (which) is utilized to manipulate, divide and deceive” (Winant). The comment of Winant is true because all human beings are equal and deserve the same respect and treatment. Winant claims that race is neither an ideological construct nor an objective condition.
