The first function we are going to look at is empowering states. The constitution limits government power. Every nation in the world cannot exist without a constitution. This means that the constitution needs a formal jurisdiction and governing body that can enforce the rules (Heywood 2013:338).In America, President Obama empowered states of America to be innovative to develop health reform models that suit their state only if they meet his criteria.

Heywood (2013:339) says that “they formalize and regulate the relationships between political bodies and provide a mechanism through which conflicts can be adjudicated and resolved.” The constitution plays an important role in providing stability in any state or nation. It can do this through the rules that are in the constitution, this means that people needs to follow the rules and if they break it they can be punished. This ensures stability in the country. An example is where President Jacob Zuma was found guilty of breaking the constitution and directly after the ruling the Rand/Dollar rate decreased because the investors saw that the judicial system still works in our country.
Protecting freedom is the fourth function of the constitution. In the constitution, there are different parts and rules that protect the rights of people. The parts are the defined by the civil rights and liberties and sometimes by the bill of rights (Heywood 2013:340).
The last function of the constitution is legitimizing regimes. In this function of the constitution is where it helps to build legitimacy (Heywood 2013:340). Through this, the state is recognized by other countries in the world. This helps the state to build and develop their status around the
