Improved Essays
In a general sense, protection orders are used to protect individuals that are victims of domestic violence (Gosselin, 2013, pg. 336). Protection orders are said to decrease intimate partner physical violence, generally decreasing the abuser from doing any more harm to the victim. (Gosselin, 2013, 336). They are said to be safe in protecting the victim from any harassment, contact, physical abuse, and etc., from the abuser (Gosselin, 2013, pg. 336). Despite the good intentions of this order, I do not believe that protection orders truly prevent intimate partner violence 100%. At the end of day, protection orders are just as good as the victim allows it to be, by doing exactly what they are told to do. Also, it is just as good as the abuser

Rape shield laws limit the use of evidence of a victim’s past sexual history that might undermine the victim’s credibility. The purpose of rape shield laws is to protect victims from emotional distress when cross-examined about their sexual history (Brody & Acker, 2010). Courts feel the victim’s sexual history has little relevance and the humiliation and fear of being questioned about their past sexual conduct might prevent some victims to come forward (Brody & Acker, 2010).. In Tennessee, Rape shield laws were adapted in response to a sexist view that a woman who had sexual relations in the past was more likely to have consensual sex with a specific criminal defendant (Brody & Acker, 2010).…

Officer discretion is the ability of officers to use logic and common sense. And, for those seeking assistance from the criminal justice system (CJS), mandatory arrest subordinates their rights and needs to that of the CJS. Advocates claim, with effectiveness that the criminal justice system has factual ignored the context, circumstances and various desires and needs of victims. Majority of states have accepted arrest policies that require police to either arrest one or both parties at the scene, or to just write a report justifying why an arrest is not made. Mandatory arrest policies are normally safer for the victim because if the abuser isn’t arrested, he or she will make the attack worse against the victim as a beating for contacting the…

When a judge releases an offender on their promise to appear at the next court date, the order shows that the judge is serious that the offender is not to contact the victim. If the judge releases the offender without an order in place and the offender in turn hurts or kills the victim would not sit well in the public eyes. Another reason that order is routinely placed into effect is to prevent the victim from having to debate with the court on why they want an order. When a victim requests a protection order, the “criminal justice system process often victimizes them further" (LaViolette, & Barnett, 2014, p.76). Mrs. Lentz was very helpful and supportive to the victims who had no knowledge of the court process.…

Two categories of AVOs exist: Apprehended Domestic Violence Orders, for domestic-relationships, and Apprehended Personal Violence Orders, for non-familiar and non-domestic relationships. Whilst the majority of ADVOs and APVOs work effectively, there are a number of aspects that necessitate reform. (Legalaid.nsw.gov.au, 2015) The most obvious example of this need for reform is the case of Rosie and Luke Batty, when an ADVO failed to protect the mother and son, leading to the death of a child. A more recent example is that of mother of three, Tara Costigan, who had “sought court protection from her ex-partner just one day before he allegedly killed her and attacked two other people...”…
