Keeping it Illegal Whether or not the sale of human organs should be legal or not has been the topic of many debates. Since the need for organs is growing, you can understand why it is the topic of many arguments. Many people wonder if this is legal, or how much money they can get if they were to sell an organ. In many countries it is legal to buy and sell organs but not in the US, although there was no law stating that individuals could not purchase and sell organs until a congress passed an act in 1984 making it illegal. If this was legal then what would stop people from cutting out their own kidneys and selling them to the nearest hospital just so they could get a few thousand bucks. It was cause supply and demand with the poor people selling and the rich people buying. If there is two people on the waiting list for an organ and one of the people is rich and the other is poor then obviously the person with the money to buy the organ that they need is going to be the person to get the organ regardless if they need it more than the other. It basically states that it is illegal to give or take organs if it affects interstate commerce. In an article written by Daniel Taylor, the National Organ Transplant Act states that anyone in violation of the law could be fined up to fifty thousand dollars and face up to 5 years in jail. This does not seem like a very large penalty considering they were caught selling organs.The only exception to this act is bone marrow. The ruling by the 9th U.S. Circuit Court of Appeals held that bone marrow donations are more like blood donations thanks to recent advances in medical technology(Taylor).
