Marlene Bamio,
Your post was extremely through throughout the texted. In addition, you kept using examples on the mentally ill people being or not being executed under the eighth and 14th Amendment prohibitions on cruel and unusual punishment. I personally believe in the death penalty with the exception of people being mentally ill, I was wondering what is your viewpoint on this situation?

The Eighth Amendment prohibits cruel and unusual punishment, so therefore one may not violate this particular law. However, what would happen if one did? Would it be justice? Well, “on June 25, 2012 the supreme court ruled juveniles who committed murder could not be sentence to life in prison because it violated the Eighth Amendment…” To this, though what would man be if we did not treat every person, young or old, equally.…

Ashley Smith was always different than others. At the age of 5 days old, she was adopted by Coralee Smith and Herbert Gober. Even considering this, she had a pretty normal childhood. At about 15 years old, she had been to juvenile court 14 times. She was expelled multiple times, she was failing schools, she had just changed from that sweet innocent little girl that she once was.…

    B. Further Verdicts- Flesh on the Bones of "Cruel and Unusual Punishment" Although significant doctrinal developments relevant to present issue have occurred in various eighth amendment cases, however Wilkerson, Kemmler, and Resweber are the Supreme Court cases that most closely address the constitutionality of various methods of execution. An in dept study of these cases will offer a more complete definition of the meaning of cruel and unusual punishment. The Court's decision in Weems v. United States, is a landmark in eighth amendment law. Weems introduced a more dynamic analysis that defines cruelty in terms of evolving social mores by breaking the earlier "historical interpretation" of the cruel and unusual punishment clause.…

Intermediate punishments, as defined by the textbook, are ‘community based sanctions that range from intensive probation supervision to no secure residential programs.’ Intermediate punishments are programs that require more supervision and punishments for a juvenile and are used as stricter punishments for them. Because of the increase in supervision, electronic monitoring devices are often used as part of a juvenile’s punishment, whether it be when they leave their house, are in public, or at all times. These are used to verify the location of the delinquent at all times. Three types of electronic monitoring devices are continuous-signal devices, programmed contact devices, and cellular devices.…

I’ve mentioned a couple times now innocent people being captured and tortured by the CIA. The number of innocent people detained by the CIA is, at least, 26. That doesn’t sound terribly bad, but it has to be remembered that the CIA detained and held “enhanced interrogations” on 115 suspected terrorists. Twenty-six is nearly a fifth of the terrorists they captured, but somehow, it gets worse. Some of the suspected terrorists were informants for the US government.…

Cruel Punishment Or Great Honor If you had to hold up everything in the world at once, what would it feel like? I imagine you would feel either like Atlas the greek titan who held up the sky or Jonas but in this case I am talking about jonas because he held all the memories of the past not only the one in his community, all of them since men started walking on earth. Jonas assignment is meant to be a great honor because one who knows the entire history knows how to improve the future, but for him it is an indirect punishment from the elders because he has to relive the painful memories for his whole life, talking the burden that no one else wants to deal with and on top of that he is the most lonely person not able to relate to anybody else.…

When I hear the words “solitary confinement,” I automatically get the feeling that it’s not very good. The first thing that comes to my teenage mind is the SHU, or security housing unit, in the Netflix original Orange is the New Black. The SHU in the show is a place that gives the viewers an idea of the effects of solitary confinement on the prisoner. The inmates’ reactions to the SHU lets the viewers understand that it’s a place that changes a person in a negative way. It even showcases the guards’ tendencies to abuse their power and threaten the inmates with time in the SHU if they didn’t behave, which is something that’s actually happening in today’s world.…

Cruel and unusual punishment is, by definition, “such punishment as would amount to torture or barbarity, any cruel and degrading punishment … any fine, penalty, confinement, or treatment that is so disproportionate to the offense as to shock the moral sense of the community” (Cruel and Unusual Punishment). The number of prisoners in the United States has climbed in 2016 to a staggering 2.2 million, up from 200,000 in 1972. A full 36 percent of those incarcerated are behind bars for nonviolent offenses. Such numbers alone should shock the moral sense, but to fully understand the nature of cruel and unusual punishment for nonviolent crimes, we must define such crimes, consider the sentences for such crimes and the injustices faced by the prisoner…

After Al-Qaeda’s attack on the World Trade Center in 2001, the United Sates felt it time to punish those responsible so as to ensure another attack would not be forthcoming. The CIA began “enhanced interrogation of detainees”; in other words, the torture of people believed to have information about the enemy. Here, I examine the reduction of a human being who lived a bios life and became a detainee whose life changed suddenly to zoe and therefore became homo sacer. The life of an individual who is homo sacer is that of zoe or bare life, that life which is common to all animals. Giorgio Agamben states that “it indicates, rather, a life that may be killed by anyone-an object of a violence that exceeds the sphere both of law and sacrifice” (pp 86).…

Loss of moral authority on the world stage is a grave consequence of torture. If the United States is seen as immoral, then how can it be seen as a leader? Throughout its history, the United States has been looked upon as a world leader, leading on issues such as human rights. In fact, the US has been a defender of the rights of people all over the world, often going to war or using its military to protect the rights and human dignity of people all over the globe. It was often held up as the beacon of freedom and human decency.…
