Police Observation Report

On October 1, 2017 at approximately 1859 hours, I observed a black 2000 BMW four door sedan traveling east on Pine Hill RD approaching Leo Kidd Ave in Port Richey, FL. I observed the vehicle to not have an attached tag. I maneuvered my unmarked agency issued patrol vehicle (116) behind the BMW and initiated my emergency equipment to conduct a lawful traffic stop.

I made contact with the driver of the BMW, who was identified by his Florida driver’s license as James Thomas Cave. James advised he had just purchased the vehicle and stated he was the owner. James provided me with a Florida motor vehicle title which was signed by the previous owner Rafael Antonio Alvarez Roman. The title was not signed by a buyer and was not dated.

A NCIC / FCIC check was conducted which revealed James to have a suspended Florida driver’s license as of July 5, 2017 due to failure to pay traffic fine (A882TRE). James was read Miranda from an agency issued card and verbally acknowledged he understood his rights. James advised he did not know his driver’s license was suspended. James admitted the vehicle was unregistered and advised it was not currently insured.

A tow truck was requested off of rotation and Ward’s Towing responded to the scene. The BMW was impounded at the Port Richey Police Department and James was provided with a PRPD notice of impound.

James was issued UTC A2ID8DE for operating an unregistered motor vehicle and UTC A2ID8EE reference DWLSR w/o knowledge. James was released on scene and promised to appear for his court date.
