Police Observation Report

On Sunday, April 10th, 2016 at approximately 0330 hrs while driving a Midland Police vehicle and wearing a standard issued MPD uniform Officer Jimenez was dispatched to the 3300 block of Neely Ave in reference to a check vehicle. MPD Dispatch informed the Officers dispatched to the scene that there was a male driver passed out at the intersection of Midkiff and Neely.

Upon arrival, Officers were able to observe a Green Nissan Titan (TXLP-DFM7235) parked at the intersection. Officers observed the vehicle was facing eastbound stopped at the intersection of the 3300 block of Neely Ave. Officers were able to observe the driver later identified as Jay Anthony Vargas (H/M-DOB07/13/1985) passed out inside the truck with the vehicle still in gear. Officer Wilson, who arrived at the scene, first was able to put the vehicle in parking and get the driver out.

Officer Jimenez also noticed Vargas had bloodshot eyes and a slurred speech. Officer Jimenez asked Vargas where he was coming from. Vargas told Officer Jimenez he was coming from a bar in Odessa. Officer Jimenez asked Vargas what bar was he coming from and Vargas said he was coming from Dos Amigos in Odessa. Officer Jimenez asked Vargas if he had to drink more than what he should have and Vargas said yes. Officer Jimenez asked Vargas how would he rate his level of intoxication. Officer Jimenez asked Vargas that on a scale 0-10, where 0 means he was completely sober, 1 means a slight loss of his physical faculties due to the consumption of alcohol, and 10 being completely drunk how would Vargas rate his level of intoxication.
