Police Discretion is at the core of policing, allowing officers to approach different situations with different approaches. Discretion is seen as the most essential element of policing, yet discretion is also the source of many problems. Over the year’s discretion has become a more prominent issue amongst the public, and due to social media and the increased use of the internet, videos and new reports can be shared with millions in a matter of seconds. Yet the truth is the discretion an officer’s use is comprehensively subjective to real-world situations rather than adopted by a certain agenda. One day an officer will hand out a ticket to a speeding vehicle because of how the civilian is talking to him, while on another day he will issue a warning. In addition to each officer, varying groups in society will be treated to different levels of discretion. When it comes to youth, more emphasis has been placed on lenient discretion because of the Youth Criminal Justice Act. In Police discretion with apprehended youth: assessing the impact of juvenile specialization the author found “a greater emphasis is placed on the structuring of discretion. Under both legislations, police officers have the power, freedom, and autonomy to use formal and informal means to handle youth-related incidents” (Schulenberg and Warren, 2009, p 4). Later on adding, “Police discretion Research finds youth officers effective and fair in their contacts with juveniles, utilizing community referrals and less intrusive measures where appropriate and feasible”. This relates to discretion and an officer having his or her own belief system. Youth receive less intrusive measures due to their age and circumstance in life, thus resulting is discretion that is more lenient. Since the increased presence of social media, plenty of videos of police have been floating around the web. Most of the videos consist of police brutality or police stepping out of line, and rarely do you see police performing an act of real justice. This does not mean police around the world intend to harm citizens, it simply means that the officers that do take it too far will always be recorded. And the officer that does his job properly will go unnoticed. This is why social media has created a false image for police, because it portrays all officers as corrupt due to a few rotten apples. Instead, all officers should be allowed to have discretion rather than creating rules and regulation for every possible scenario. Creating regulations for all possible scenarios it costly and pointless, at the end of the day an officer will choose whether he should pull his gun, or not give a speeding ticket. Even though the officer understands the law, he or she will use discretion to a degree when coming faced with a

Firstly, in understanding Police discretion someone would want to know if the concept has any benefit to society. In fact there are many strengths or advantages associated with the principle of police officers using their discretion. When a police officer uses his or her discretion it allows them to make a decision that is fair and humane, which in turn can improve the way people view the police. If the police were to follow the laws to latter, they would be perceived to be unfair to society and hence rejected (Rivera, 2006). This shows a major strength in the use of discretion by police officers mostly because it helps to build the moral of the officer and also contributes in building a community’s trust in the police, for example in…

The criminal justice system often is examined using political, organizational, or sociological approaches [or lenses] (Pollock, 2010). Asking [simply] whether something is legal [or illegal]…is not necessarily the same question as asking whether something is right [or wrong] (Pollock, 2010). The term “ethics” or “ethical” refers to something “being in accordance with the accepted principles of right and wrong that govern the conduct of a profession.” In the case of police officers, use of discretion, or a lack thereof, in the application of force has direct ethical consequences to which the objectivity of the police officer on scene is subjugated by the subjectivity of a review board after the fact. Laws influence police behavior and how officers handle some situations. Officers are rarely supervised while on patrol and if they are, it is by a fellow officer rather than a superior officer. Because of this, officers are left with discretion in almost every situation they encounter. This discretion for the law also influences how things are handled in the police subculture. This same law is used not only by police officers but also against them when there is suspicion of wrongdoing.…

Use of Deadly Force Police officers, or any type of law enforcement are here to protect us from any harm. Discretion is something that law enforcement uses and plays a major role in policing. Many people have their own opinion on whether police officers are doing their job the right way. Of course we all have our own views and what the “right way” is and how it differs from people to people. What I believe is that many police officers are not doing their job right due to the fact that there have been many cases in which it is demonstrated that police officers have taken advantage of their position and have used discretion in an inappropriate manner.…

Aside from issues where the law is clear in what an officer “shall” do, the constraints may become more apparent in regards to the community’s perception of certain crimes, community demographics, and the officers themselves. I have experienced this with refugee communities, and it clearly affected how I exercised discretion. In some cases, it became a teaching moment on both the community and me as to what is acceptable behavior and what is not. Taking the time to realize that even though refugees receive some “training” before they arrive in the U.S., not everything is addressed, and assimilation takes time.…

Discretion gives the officer choices that he or she may explore and allows the officer to apply the best particle decision for a particular encounter. Without discretion, in my opinion, I believe that police officers would never have the time to answer calls for service or conduct any other job function with the exception of conducting traffic stops. If an officer had to enforce all traffic laws, all of the time, the officer would never make it far from the station. At the start their shift and for the entire shift they would commit to only being able to enforce traffic violations. “Discretion in enforcement and prosecution of crime is inevitable; it can be restrained at the margin, but it cannot be eliminated” (Thomas III, 2005, p.…

In his essay “For Cops…” Kevin Johnson claims that videos of police officers are placing their actions under new scrutiny and changing the way that claims against officers are played out in court. Police have responded by trying to limit such recordings when they feel that they interfere with police actions. The fear that is most present in law enforcement is that these videos will cause officers to change how they behave in a life or death situation. To combat this, officers are now receiving training to deal with being recorded.…

Society sees police officers as role models that serve and protect the community and its citizens. Along with that police prevent crime, maintain order and investigate crimes and apprehend criminals. I emphasize the “serve and protect the community and its citizens” especially citizens because in today’s society we are not protected by the men and women who we thought will protect us the most. Every time I turn to channel 7 or any news channel I see different person brutalized and just treated like they aren’t humans.…
