Question- You are a physical therapist employed at a physician owned physical therapy clinic. The clinic charges patient by the modality used. The physician who is an owner of the clinic, requests that all the patient’s should receive at least a minimum of three modalities which included heat, ultrasound, and electrical stimulation during each session. Can you legally and ethically comply with the owners order?
Answer- No, knowingly ordering unnecessary modalities which are not medically necessary to gain a benefit constitutes for a fraud.
Consequences- Under the False Claims Act, the penalties for violation are significant. The provider can be charged between $5,500 and $11,000 per claim, plus three times the damages sustained by the government.
