1.0 Introduction
The purpose of this report is to provide a basis for discussion in the consideration of the appropriate contract choice which will then help to determine the chosen procurement route for the proposed construction works at Philpot Lane.

This report provides an introduction to the project, and then considers what is meant by contract and procurement.

Following this, in section 5.0 we seek to identify and consider our key requirements for the project and how these can achieved when choosing the appropriate form of contract.

Finally we offer a conclusion for consideration based on the information provided within this report.

2.0 The project
The works proposed for Philpot Lane can be broken down into two parts, as follows:

External/ Building

3.0 Procurement and Contract Explained
The words ‘procurement’ and ‘contract’ are frequently used to describe the same things in construction. They are however not the same thing at all.

The procurement route is the way in which the construction is tendered and bought in the market.

The contract is the legal agreement which records what was achieved from the procurement exercise.

Despite being different they are obviously very much linked, hence the confusion in terms.
4.0 Contract Options
We have decided to consider three contract suites which we have identified as viable options for adoption; these have all been subsequently explored for the proposed project at Philpot Lane, London.

The following options below provide a different balance of risk, flexibility and control, and are as follows:

1. JCT Standard Building Contract Without Quantities 2011

2. NEC3 Engineering and Construction Contract

“NEC is now the second most commonly used standard form after the JCT suite” (Kingston, 2014)

3. FIDIC Conditions of Contracts for Construction - The Red
