Chuck, Yesterday Electrocon received a request from Jacob Lien of Ulteig for support in conjunction with work being done for Rochester Public Utilities. In reviewing your account, we believe there may be a violation of the CAPE license agreement occurring regarding the use of your CAPE license by a third-party. Your agreement does not allow your non-employee consultants to use CAPE outside your own premises. If Jacob is working at your office, there is no violation. If he is working outside of your facility, then Ulteig will need to acquire their own license for CAPE or Rochester Public Utilities will need to add Consulting Rights to your maintenance agreement.…

For the reasons stated in Part I, supra, the only issue to which the Members should be heard on is whether they are liable under the putative contract, and not whether Plaintiff is liable under the putative contract. The Members have no interest in Defendant’s breach of contract action against Plaintiff, because the Members’ liability under the putative contract is not at issue. As such, if the court grants the relief requested in Part I, supra, the failure to amend the scheduling order following this Court’s order directing the joinder of the Members does not result in an injustice. 21.…

One of the major ill-decisions made by Lee that contributed to the overall defeat of the Confederate army at the Battle of Gettysburg was the ordering of Pickett’s Charge. Pickett’s Charge is considered one of the most famous events during the three day battle. It took place on the third day when Lee ordered General George Pickett plus six brigades from adjacent corps to charge up the middle of Cemetery Hill where the Federal center was located and ultimately unhinge Meade’s entire force. The plan was an intricate one that involved 13,000 troops charging straight up the middle of the Union ranks preceded by artillery bombardment at the intended point of attack. Additional reinforcements were also appointed to exploit the break.…

The recent events surrounding this NFL player have inspired me to take a deeper look into parenting styles in regards to corpral punishment, how discipline techniques are critized , and how or if there is any social impact on society. Mr. Peterson, running back for the Minnesota Vikings, was recently indicted on charges of reckless or negligent injury to a child and charged with one count of injury to a child for spanking his four year old son with a “switch”.…
