Isn't the town responsible for the sidewalk's upkeep? This could be the case if the sidewalk is public property. If you live in a private development for example, then you own the sidewalk. Its maintenance is your responsibility. Anyone suffering an injury because of the sidewalk's poor condition can sue you for damages. Depending on local laws, you may be responsible for the upkeep of a sidewalk that's public property, that is, the section that goes by your front yard.
