Statement of Facts

Nick Spears, an attorney at Tapken & Tapken, was arrested for Driving While Intoxicated at the gated golf-community while at a party for one of the partners of the firm, Joyce Tapken.
On September 21, 2014, Spears attended Joyce Tapken’s dinner party at her home located in the gated golf community called Havila Estates. Havila Estates is home to 200 single family residences. The area is surrounded by a fence and contains only one entrance into the community. A security guard is present at the entrance at all times, however, one only needs permission from a resident of the community to enter. Once an individual is inside the gates, he or she is free to go about the neighborhood.
While at the party Spears consumed alcohol
