D & H Mining, Inc. employed me for two months as an off side (return side) roof bolter at the No. 3 mine. Danny Tucker owns and operates the No. 3 mine and Gerald Ball is the section foreman. No. 3 mine produces coal with a continuous miner. The day shift worked from 7 am to 5 p.m., 10 hour shifts Monday through Thursday and eight hours on Fridays and every other Saturday.

I carried the Personal Dust Monitor (PDM), when the company conducted dust surveys to measure the respirable dust concertation on the section during the work shift. The PDM was already running when I arrived at work at 06:45 am; I do not know who started the pumps. The PDM was set to shut off at nine hours and most of the time Electrician Earnest Cook took it to the surface.

I did my own checks on my PDM because I am certified in dust sampling and maintenance but I did not sign any dust cards. Ball also checked my PDM throughout the work shift; I guess he was certified in dust sampling. I only saw Tucker underground one time during the two months I worked at No. 3. Tucker was never at the mine when I arrived at 06:45 am, and he was very seldom at the mine at the end of the shift. Tucker is in the process of getting the D & H, No. 2 mine located at Hurley Virginia in operation.

The straps were cut off the PDM and I could not carry it on me; I would place it on the roof bolter within 3 feet from where I was working. The screen on the PDM would show the average dust concertation. When I saw that the average dust concertation was exceeding the dust level I would hang the PDM behind the closes check curtain away from the roof bolter. Ball knew I was taking the PDM out of the dust and hanging it behind the check curtain.
