I arrived to the location and noticed that the vehicle hit the embankment, struck a mail box and landed approximately 20 feet in the ditch. The vehicle was not occupied therefore; I asked who is the driver of the vehicle was. The driver identified herself as Monica Bettis.
Bettis stated she tried to avoid a deer and lost control of the vehicle. I retraced the the skid marks and noticed that the skids marks started in the curve section of Sigman Road.
As I talked to Bettis, I noticed the smell of alcohol emitting from her breath. I asked Bettis if she consumed any type of alcohol and she stated ”yes” at Marshalls sports bar, 1180 Sigman Road. Bettis stated she consumed …show more content…
I also observed her eyes were red and glassy.
The environment conditions were lightly wet (the rain started as I arrived), hard, slight incline, and non-slippery surface. Bettis had on heals and had taken them off.
I then asked Bettis to submit to a series of standardized field sobriety tests to determine whether or not she was impaired. I asked Bettis if she had any injuries that would keep him from being able to walk or stand on one foot. Bettis advised she had no such injuries and consented to the tests. My emergency lights were turned off prior to testing.
The first test was Horizontal Gaze Nystagmus - Bettis was wearing glasses. I asked Bettis could she see my finger approximately 6in from her face without her glasses and she stated “yes”. Bettis’ eyes were brown in color. Both eyes had equal pupil size and tracking. Both eyes were positive for lack of smooth pursuit. Both eyes were positive for distinct and sustained nystagmus at maximum deviation. Both eyes were negative for nystagmus prior to 45
