I have a confession to make, I enjoy the practice of Criminal Defense. As a criminal defense attorney, I represent those charged with a crime, whether it's traffic, DWI/DUI, misdemeanor or felony. As per the explanation I have heard from many people, I defend the 'scum of the earth.' Since deciding this was my area of practice as an attorney, I have heard from friends, family and even total strangers that my chosen profession is 'wrong,' 'despicable,' I've even been told what I do is "what's wrong with America." I try to have a legitimate discussion with these individuals to explain my decision to practice criminal defense. Sometimes, these discussion go well, other times they do not. In either case, publishing an article which conveys the rational of this criminal defense attorney might provide some insight to those who otherwise do not understand, and certainly do not approve of, defending the accused. …show more content…

I headed into the courtroom of Judge Thomas Marcelain to observe my first courtroom trial. The trial involved a 31-year-old man named, Daniel Bohanna, of Pataskala. Mr. Bohanna decided to represent himself in his trial for fear of misrepresentation. He was charged with rape, kidnapping, and felonious assault. I have seen footage on T.V. from famous trials and of course seen reenactments from Hollywood, but I have never been to one in person until now.…

It is 7:23 a.m. on a Thursday morning, the pass allowing tardiness to first hour is tucked away in my tattered blue backpack. I sit in my car gazing at the quiet building. I have seven minutes to make it up the staircase, adorned with two lamp posts. I, along with many others, have visited Morgan Federal, the bank across the street, countless times and never realized just what was in the vicinity. A friend who works next door in the courthouse suggested I profile this place and gave the directions: “It’s in the old jail,” as if that was a common reference automatically understood.…

ding. If I were in this situation as the parole officer I would do my best to try and help to mother, in whichever way possible. I know this would go against my beliefs and rules that I must follow as a parole officer but I still think I would try my hardest to help this mother get back on her feet and be able to provide for her children. I think many people would jump the gun and file a violation report on this specific issue, as she is violating her probation, but I don’t feel that would be the best way to approach this situation.…

Criminal lawyers have obligations towards the law and the civil society. As we look at the American Justice System today, we often noticed that lawyers tend to work more closely with the judicial system than with the public. Lawyers have not only failed the justice system but also the institution they have swore to serve. Lawyers have failed in their everyday practice to ensure that our current criminal system functions consistently with our rights and values. Prosecutors have become more interested in accomplishing their own career goals than to serve their society.…

The role of any attorney can be viewed in three parts: as a participant of the legal business, a delegate for clients and also an everyday civic resident of their community. Although it may seem as if the responsibilities amongst attorneys are equally distributed across the board, I feel that the role of a defense attorney at times can seem a bit more problematic. Discretion within any profession whether it is Law Enforcement, Prosecutors, Correctional Officers and or Judges can affect the moral principles and ethics of any person when having to make a decision. The responsibility of a Defense attorney is highly vital to any case or any client. I am going to discuss the role of a defense attorney and what the responsibilities consist of.…
