Parens Patriae Parens Patriae is the power of the state to act on behalf of a child and provide care and protection equivalent to that of a parent. It was first used by English kings to establish the right to intervene in the lives of the children of their vassals. The courts used this to safeguard the welfare of orphans and protect their property and inheritance rights; arguing that the children were under the custody of the king (Chancery Court pg.13).
