You have asked me to research the ethical rules about what is permissible for the website that you plan to create for the law firm. I have conducted legal research on the following issues and am presenting my findings, as follows:
1. Does the website have to list the state where s/he is licensed to practice?
Yes, the website does have to list the state or states where he/she is licensed to practice law. In ABA Model Rule 5.5: Unauthorized Practice of Law; Multijurisdictional Practice of Law, it states that a lawyer can not mislead, or withhold their jurisdiction of legal practice to the public, or …show more content…
3. Is it permissible for the attorney to list famous clients or well-known cases s/he has worked on?
Yes, it is permissible for the attorney to list famous clients or well-known cases s/he has worked on. In ABA Model Rule 3.6: Trail Publicity, states that a lawyer can say things that are of common, public knowledge, and/or public record, such as what type of case it was, the people involved, the outcome of the case, the type of defense or offense used in the case, anything that is of public record and/or knowledge maybe listed on their website as long as it is within the realm of the law, is publicly known and is truthful facts and not misleading. The lawyer also must obtain informed consent from the form client/clients according to Model rule 1.9: Duties to former clients: state the lawyer cannot reveal information to representing a client unless the client gives informed consent and rules permit, and its in writing.
4. The attorney would like to pay a former client, Susan Turner, for a quote about how well she was represented in a personal injury lawsuit. Is this permissible?
