Facts: Mr. Owens sent a letter to Mr. Tunison asking him to sell his property for $6,000.00. Mr. Tunison replied stating “it would not be possible for me to sell unless I was to receive $16,000.00 cash.” Mr. Owens responded that he accepted the offer for $16,000.00 payable in cash, to which Mr. Tunison replied he did not wish to sell his property. Mr. Owens filed a suit for damages resulting from Tunisons refusal to sell.
