Off Duty Officer Cons

Decent Essays
Many officers encounter situations while off duty were they are forced to use their position as officers to enforce the law. When the officers are put in this situation they are also opening themselves up to civil liabilities. These civil liabilities could be a range of things such as whether or not they were acting as a civilian and or employee to another business or an officer. Another question that comes up is whether or not the officer was acting in way that would make the outcome of the situation favorable to him.

If the situation above were to occur the question of whether the off duty officer would be civilly liable for the man’s death would come down to whether the officer was acting as a civilian or an officer. I do not believe he

In 1977 Fusilier v. Russell dealt with intoxicated drivers and the police failure to arrest. The plaintiff brought criminal action against two Louisiana Sheriffs for failure to arrest or restrain an intoxicated driver. The subject had later become involved in a motor vehicle accident that left the victim/plaintiff severely burned. Prior to the accident deputy sheriffs were responding to a call from a nightclub where they were to evict a disorderly customer. When the officers arrived they noticed an intoxicated person in the parking lot.…

The officers, Eric Joering, 39, and Anthony Morelli, 54, had responded at 12:10 p.m., eight minutes after the call, about a potential domestic situation. They were immediately met with gunfire, as they went into the apartment. Officer Joering died at scene.…

As Chief of Police during and after the decision of Tennessee v Garner, I would implement stricter use of force policies holding each officer accountable and completing a thorough investigation into all excessive use of force and deadly force incidents. Additionally, a review and revision of officer training in the use of force and apprehension procedures would be required for each officer during annual training and new recruit training. Likewise, the implementation of procedures which require command staff to be aware of situations where officers who have had incidents of use of force and the monitoring of those officers to determine if there are outside factors which may contribute to the use of force exhibited in the performance of their…

The public duty doctrine defenses are subject to the special duty exception. The special duty exception does not create liability. However, it operates to negate the public duty doctrine defense and allows a victim to pursue a possible cause of proceeding under the GTLA (Government Tort Liability Act). (Scott, 2008) Police have an obligation to protect the public at large and therefore do not have a duty to protect individual citizens.…

Military authority figures represented as officers have the duty to uphold the law and protect the people; protect and serve. Ideally, this duty would be performed by looking into cause and effect when it relates to crimes. An officer typically asks a suspect questions, proceeding with caution, followed by using his or her judgement of the suspect’s consequences. In cases of suspect hostility initial actions might include handcuffing, or at least that is what is portrayed in the movies. In today’s society it seems that such subtle actions are not initially taken and the law of “shoot now ask questions later” is upheld.…

Police Subculture The police subculture is much the same throughout all the law enforcement careers throughout the world. The police subculture is a distinctive set of beliefs, values, attitudes, and behaviors that are shared amongst the majority of officers working in law enforcement organizations (Malmin, 2012). The subculture is taught to new recruits from the first day they arrive at the academy to the last day. This subculture follows them from that point on throughout their career in law enforcement.…

As a fellow active duty officer of the department, I would strongly disagree and protest the validity of only officers holding a four-year college degree to be eligible for promotion to Sergeant. Although it is understandable that administrators want to move towards a command staff where those officers rising through the ranks are deemed professional; holding degrees in areas relevant to the performance of the duties of law enforcement and its operation, the experiences and life skills of those officers not possessing a degree is perhaps more effective in the daily performance of routine duties on the street. As suggested by Doener (2012) in “Introduction to Law Enforcement, An Insider's View”, the evidence of college-educated officers offering…

The two major roles for officers is the crime-fighting role and the order maintenance role. The difference is how crime is handled. For the crime-fighting role, their approach is more upright by battling and eliminating crime hands on. Another way to describe it can be “kicking ass and tacking names.” For the order maintenance role, they handle crime by tying to prevent before it happens.…

When I started to become interested into the realm of the criminal justice, I knew that police officers’ main objective in their job was to protect American citizens and their fundamental rights from possible harm. Yet, I did not comprehend that individuals’ roles as police officers was more well-rounded and diverse besides preventing crime. For the American police system, besides the educational and training standards that a police-in-training must endure, there are major responsibilities and roles that a police officer must take when on duty. The four main roles of police work follows the acronym LOIS: law enforcement, order maintenance, information gathering and service. Law enforcement basically consists of police officers detecting…
